These Terms of Service ("Terms") govern your use of evoxenusa.com and purchases from EVOXEN LLC, a [STATE OF ORGANIZATION] limited liability company trading as Evoxen USA ("we", "us"). By placing an order you agree to these Terms, our Refund & Return Policy, our Shipping Policy and our Privacy Policy.
1. Who we are
Evoxen USA is an independent online retailer of 5 Core-brand car audio products. We are not owned by, endorsed by, or affiliated with 5 Core except as a reseller. 5 Core and its logo are trademarks of their respective owner; product names and images are used for identification only. Orders are fulfilled on our behalf by our supplier, but your contract of sale is with EVOXEN LLC.
2. Products and information
We describe products as accurately as we can based on manufacturer information. Power ratings (e.g. "peak watts") are as published by the manufacturer. Please confirm size and mounting depth fit your vehicle; we are happy to help by email. Professional installation is recommended.
3. Prices and payment
- All prices are in US dollars (USD) and you are charged in USD. Any EUR amounts shown are for information only. Your card issuer may apply currency conversion and foreign-transaction fees.
- Shipping charges are shown at checkout before you pay. For EU orders, import VAT and duties may be payable on delivery as explained in the Shipping Policy.
- Payments are processed by Square. We may correct obvious pricing errors; if an item was mispriced, we will contact you and you may cancel for a full refund.
4. Orders and acceptance
Your order is an offer to buy. After payment you receive a payment confirmation; the contract is formed when we confirm acceptance by email or when we dispatch the goods, whichever is first. We may decline or cancel an order (for example if an item is out of stock, cannot be shipped to your address, or we suspect fraud); in that case we refund any payment in full.
5. Delivery, returns and warranty
Delivery is governed by our Shipping Policy. Returns, refunds, the EU 14-day right of withdrawal and the EU 2-year legal guarantee are described in our Refund & Return Policy. Products may also carry a manufacturer warranty, which is in addition to your statutory rights.
6. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential losses, or for damage resulting from improper installation, use outside the product's specifications, or modification. To the extent permitted by law, our total liability arising from an order is limited to the amount you paid for that order. Nothing in these Terms excludes or limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, fraud, product liability, or your statutory rights as a consumer (including the EU legal guarantee of conformity and right of withdrawal).
7. Use of the website
You may not misuse the website, attempt to interfere with its security, or use it for unlawful purposes. Website content is owned by us or our licensors.
8. Governing law and disputes
These Terms are governed by the laws of the State of [STATE OF ORGANIZATION], USA, without regard to conflict-of-law rules. Courts located in [STATE OF ORGANIZATION] have jurisdiction. If you are a consumer residing in the EU/EEA, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of your country of residence.
9. EU consumer information
- Online Dispute Resolution: The European Commission's ODR platform (formerly at https://ec.europa.eu/consumers/odr) was discontinued on 20 July 2025. Please contact us first at [CONTACT EMAIL]">[CONTACT EMAIL]; we aim to resolve complaints within 14 days.
- We are not obliged and do not undertake to participate in dispute resolution proceedings before a consumer arbitration board, but you may still use any out-of-court body available to you under your national law.
- The contract language is English; a Traditional Chinese translation is provided for convenience. Where EU consumer law requires, you may rely on either version.
- We do not store a copy of the contract text for you; please save or print these Terms and your order confirmation.
10. Changes
We may update these Terms; the version in force when you place an order applies to that order.

3. 價格與付款

- 運費於付款前在結帳頁面顯示。歐盟訂單的進口增值稅與關稅可能於收貨時支付，詳見運送政策。
- 付款由 Square 處理。明顯的標價錯誤我們得予更正；如商品標價錯誤，我們會聯絡您，您可取消並獲全額退款。
4. 訂單與接受
您的訂單為購買要約。付款後您會收到付款確認；當我們以電子郵件確認接受或出貨時（以較早者為準），契約即成立。我們得拒絕或取消訂單（例如缺貨、無法配送至您的地址或疑似詐欺），此時將全額退款。
5. 配送、退貨與保固
配送依運送政策辦理。退貨、退款、歐盟 14 天撤回權及歐盟 2 年法定保證詳見退款與退貨政策。商品可能另有製造商保固，此為法定權利以外的額外保障。
6. 責任限制
在法律允許範圍內，我們對間接或衍生損失，以及因不當安裝、超出規格使用或改裝所致之損害不負責任。在法律允許範圍內，我們就單筆訂單的總責任以您為該訂單支付的金額為限。本條款不排除或限制依法不得限制的責任，包括因過失致死或致傷、詐欺、產品責任，或您作為消費者的法定權利（包括歐盟法定符合性保證與撤回權）。

您不得濫用本網站、干擾其安全或用於非法目的。網站內容為我們或授權人所有。
8. 準據法與爭議
